Andrea Jordan Photography.com (the “Site”) is owned and operated by Andrea Jordan. These Terms of Use apply to your access to and use of the Site, any in-person or online services provided by Andrea Jordan (the “Services”) and your purchase of photographic prints, canvases or other related products (“Products”).

Your use of the Services and/or your purchase of Products is expressly conditional upon your agreement to these Terms of Use. If you do not consent to these Terms of Use, you are not permitted to use any of the Services or purchase any Products.

If you access the Services or purchase any Products on behalf of a company or other entity, you warrant that you are an authorised representative of such company or entity with the right to bind such company or entity to these Terms of Use.

The Services are not targeted towards, nor intended for use by, anyone under the age of 13. If you are between the ages of 13 and 18, you may use the Services and/or purchase Products only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use.

Returns and refunds

All Products are printed to the highest standard using archival inks and high quality, long lasting canvas and photo paper.

Your order will be delivered, posted or available for pickup 2 to 4 weeks after it is placed. All orders are to be inspected by you at pickup or delivery to ensure that they meet your approval.

Wall art products can be easily damaged, so please handle your products with extreme care. Damage incurred as a result of improper handling or hanging is your responsibility.

Under the Consumer Guarantees Act 1993 (the “Act”), you may seek a refund if your Products:

• Are not of acceptable quality (as defined in the Act)
• Are not fit for a particular purpose that you asked about
• Do not match the description given in advertisements or sales brochures, or by Andrea Jordan
• Do not match any samples you were shown.

Your Product must be returned within 7 days of pickup or delivery. Before you return your Product please seek email confirmation from Andrea Jordan Photography and include your first name and surname, product details and reason for return.

Andrea Jordan Photography does not offer refunds on Products that were incorrectly selected or because of a change of mind.

This Site and its contents belong to Andrea Jordan, except where indicated otherwise, and all copyright belongs to her. All rights are reserved except as expressly stated.

You may not modify, copy, distribute, publish, reproduce or create derivative works from, or in any way exploit in any format whatsoever, any of the content on the Site nor any of the Products that you purchase, in whole or in part, without Andrea Jordan’s prior written consent.

Privacy Policy

The Site contains information and tools that you can browse and access without providing any personal details.  Where you voluntarily provide personal details I will only use that information for the purpose for which it was intended and to communicate with you.

Your privacy is important to me. Any personal information you submit is stored securely by me (or a service provider contracted by me for that purpose) and will not be disclosed to any third parties, except as required or permitted by law (including the Privacy Act 1993).

Cookies

A cookie is a small piece of text which asks permission to be stored on your computer (wouldn’t it be so much better if it had chocolate chips?!).  Once you agree, the text is added and the cookie is used for remembering data about you (such as IP address; dates and times of visits, documents opened and links clicked).

The Site uses cookies to collect data about each visit to this website.  That data is then used to generate statistics about how the Site is used (e.g. what pages are accessed).  This assists me to understand what is important to you and further improve the Site’s performance and/or usefulness to you.

The Site’s cookies are not executable – they are neither spyware nor viruses. If your web browser allows you to, and you decide to, reject or disable the Site’s cookies, it could make some aspects of the Site unusable.

In no event will the aggregate liability of Andrea Jordan, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, arising out of or relating to the use of or inability to use the Site, the Products or the Services, exceed compensation you pay, if any, to Andrea Jordan for the Products or the Services.

Andrea Jordan does not warrant or represent that the Services or the description of the Products are accurate, complete, reliable, current or error free or that the Products, the Services, her servers or email sent from the Site or from Andrea Jordan are free of viruses or other harmful components.

Andrea Jordan is not responsible for typographical errors or omissions relating to pricing, text, photos or videos. Andrea Jordan makes no warranty or representation regarding the availability of the Products or the availability, reliability or security of the Services and will not be liable for any unauthorised access to or any modification, suspension, unavailability, or discontinuance of the Products or the Services.

Affiliate disclaimer

If you purchase through links on this Site Andrea Jordan may receive a commission payment. Some recommended products are her own, others she may be affiliated with and yet others she may have no affiliation with.

Andrea Jordan may make third party content and services available on or through the Site and/or the Services (“Third Party Services”) solely as a convenience to you (for example, links to third party websites, software and other services). When you leave the Site, you should be aware that these Terms of Use no longer govern your use of such websites and services or any content contained there.

Andrea Jordan does not imply endorsement, verification, affiliation, approval, or control of any Third Party Services by making such services available. Andrea Jordan makes no claim or representation regarding, and accepts no responsibility for, the quality, accuracy, nature, ownership or reliability of Third Party Services. Your use of any such Third Party Services is solely at your own risk and subject to the applicable terms and conditions and privacy policies for such Third Party Services.

Andrea Jordan does not in any way endorse any website, organisation, or person who has off-site links to the Site.

Unsolicited emails

Publication of email addresses and other contact information on this Site should not be taken as deemed consent to receiving unsolicited electronic messages.  Anyone wishing to send commercial electronic messages material must comply with the requirements of the Unsolicited Electronic Messages Act 2007.

Andrea Jordan reserves the right to change, modify, revise or otherwise amend any provision of these Terms of Use, and any other terms, policies or guidelines governing your use of the Services and/or purchase of the Products, at any time at her sole discretion by providing notice that the Terms of Use have been modified. Governing law

These terms of use are governed by New Zealand law and the courts of New Zealand will have exclusive jurisdiction in relation to any proceedings relating to the Site, its contents, the Services, the Products or these Terms of Use.
